Terms

About these terms

These terms are between you and Glowar Ltd (company number 14099798, registered office Henge Barn, Pury Hill Business Park, Alderton Road, Towcester, Northamptonshire NN12 7LS, United Kingdom), which operates Humatone. By using this website, the Humatone console or the platform, you agree to them. If you use Humatone for an organisation, you confirm you are allowed to accept these terms for it.

Definitions

Using the website

You may use this website to learn about Humatone and contact us. You must not:

• copy or republish substantial parts of it for a commercial purpose without our permission;
• try to get unauthorised access to it or to our systems, or test their security without our written agreement;
• disrupt it, including with automated traffic;
• use it in any way that breaks the law.

We try to keep the website accurate and available, but we provide it as it is and may change or withdraw it at any time.

Early access

• Places are at our discretion. Asking for early access does not guarantee a place.
• Pre-release. During early access the Platform is still being built. Features may change, break or be withdrawn, and there are no service levels unless your customer agreement sets them.
• Test mode first. Test mode uses fictional numbers and is not charged. Live use requires a plan and, for phone numbers, your organisation’s business details.
• Confidentiality. What we show you during early access that is not public, including documentation, specifications and pricing, is confidential. Please don’t share it outside your organisation.
• Feedback. If you send us ideas or feedback, we may use them freely and without payment.

Acceptable use

You must not use the Platform, or let a persona be used, to:

• impersonate a real person, or make a persona look or sound like a real person, without that person’s documented consent;
• deceive anyone about who they are dealing with, including by denying that a persona is an AI when sincerely asked;
• defraud, phish, scam or obtain payment or credentials under false pretences;
• make unsolicited marketing calls or texts, or contact anyone in breach of the Privacy and Electronic Communications Regulations, telephone preference services or equivalent rules where they are;
• harass, threaten, abuse or discriminate against anyone;
• talk to children without safeguards suitable for them and a lawful basis for processing their data;
• give medical, legal or financial advice that people may rely on, without qualified human oversight;
• influence elections or impersonate a candidate, party or public body;
• record anyone without telling them, or collect special category data without a lawful basis;
• generate sexual content involving minors, or any content that is illegal where you or your end users are;
• reverse engineer the Platform, extract its models or assets, or use it to build a competing service;
• overload or interfere with the Platform, or get around its limits or safeguards.

You are responsible for your personas, your brain and what they say and do, and for having the rights and permissions your use needs. Anyone can report misuse of a persona to us at [email protected].

Honesty with the people personas talk to

Personas may speak as people at work, with names and manners of their own. But a persona must never deny being an AI when someone sincerely asks, and anything written that presents a persona must not claim it is human. Our hosted brain applies this rule for you; if you use your own brain, you must apply it yourself. You must tell end users when a call is recorded, and the Platform only records calls where they are told.

Numbers, calls and texts

• Your name, your responsibility. Phone numbers are issued in your organisation’s name using the business details you give us, which must be true and kept up to date. Regulators and carriers may require more.
• No emergency calls. Humatone numbers and personas are not a means of contacting emergency services and must not be offered as one.
• Opt-outs. When someone asks not to be called or texted again, you must honour it. Replies such as STOP to a text are honoured automatically, and you must not get around that.
• Releasing numbers. A released number is held for a short period in case you want it back, then returned to the carrier. We cannot always get a number back once it has gone.

Faces, voices and other Humatone assets

Humatone designs each persona’s face and voice. They are not copies of any real person. Humatone Assets belong to us or our licensors. While you are a customer, we give you a licence to use the Humatone Assets of your personas on the Platform and, where your plan allows, in your own materials about those personas. The licence ends when your subscription does. Once built, a persona’s face and voice stay the same unless you ask us to change them.

Your content and your brain

You keep all rights in Your Content and your brain. You give us permission to use Your Content only to provide the Platform to you, keep it secure, and meet our legal obligations. We handle personal data in Your Content as your processor, under our privacy policy and your data processing agreement.

Our intellectual property

The website, the Platform, and the names, logos and designs we use are owned by Glowar Ltd or its licensors and are protected by intellectual property law. These terms do not give you any rights in them beyond those set out here.

AI output

Personas are powered by AI. What they say can be wrong, incomplete or unsuitable. Where you use our hosted brain, it answers from what you give it, and you should check its knowledge and test it before going live. You are responsible for decisions made using what a persona says or does.

Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, for this website and early access, which are provided free of charge, we are not liable for any indirect or consequential loss, or loss of profit, revenue, data or goodwill, and our total liability to you is limited to £100. Liability for the paid Platform is set out in your customer agreement.

Suspension and ending

We may suspend a persona, a number or a workspace without notice where we reasonably believe these terms are being broken, where an end user is at risk, or where a regulator, carrier or the law requires it. We will tell you why unless we are not allowed to. You may stop using Humatone at any time; ending a paid plan is covered by your customer agreement.

Changes to these terms

We may update these terms. We will change the date at the top, and tell customers about significant changes in advance. Continuing to use Humatone after a change takes effect means you accept it.

Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
